Drug Testing in Montana Task Force
Our Montana drug testing statute has been a source of frustration for employers who wish to have an employee drug testing program. In talking with employers, legal counsel, and state legislators there has been interest in changing the statute. I have put together some resources to look at when considering what these changes might look like in preparation for the 2009 legislative session.
You may want to start by reviewing our current statutes, “Montana Workforce Drug Testing Statute,” and “Montana WC limitations.”
The document called, “Statute components tracking” has a list with “current”, “suggested”, and “assign”. I propose to fill in those blanks as we make recommendations. For example, under definition of “employee” I would suggest “change” and assign a task force member to make a recommendation, “Sturdevant”. If you look at the document “Sturdevant recommendations” you will see my suggestions.
Please email any recommendations to me and I will put a document on the website with your recommendations and track those on the “Statute components tracking” form.
I would be grateful to entertain any ideas for a more efficient way to try to start dialog about the choices.
There are folders with statutes from other states for you to review. I will add additional states and other resources as I have time. Please send me any info which you would like to have added.
